Terms of Service

These Terms of Service ("Terms") are an agreement between you and OmniGame ("OmniGame", "we", "us") governing your use of our mobile games and applications (each, an "App") and this website. By downloading, installing or using an App, you agree to these Terms. If you do not agree, do not use the App.

1. Licence

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your own non-commercial entertainment. We reserve every right not expressly granted here. The App is licensed to you, not sold.

2. What you may not do

• Copy, modify, translate, reverse-engineer, decompile or disassemble the App, except to the extent that applicable law expressly permits it despite this restriction.
• Rent, lease, lend, sell, sublicense or redistribute the App.
• Use cheats, bots, automation, memory editors or modified clients, or otherwise interfere with normal gameplay.
• Generate artificial ad impressions or clicks, or interfere with our advertising or measurement.
• Remove or obscure any proprietary notice, or use our name, logo or artwork without written permission.
• Use the App in any way that breaks the law or infringes anyone's rights.

3. Virtual items and in-app purchases

Some Apps offer virtual currency, boosters, cosmetics or an ad-free upgrade ("Virtual Items"). Virtual Items are a limited licence to use a feature inside the App. They have no monetary value, cannot be redeemed for cash, and cannot be transferred or sold outside the App.

All purchases are processed by Apple or Google under their own terms, and all refunds are handled by them, not by us — use Apple's "Report a Problem" page or the Google Play refund flow. If a purchase fails to deliver, write to support@omnigame.cc with your receipt and we will make it right. Consumers in the EU, UK and other jurisdictions with statutory withdrawal or refund rights keep those rights in full; nothing here limits them.

We may change the price, availability or in-game effect of Virtual Items, and we may discontinue an App. If we discontinue an App, unconsumed Virtual Items may become unavailable; where the law requires a refund in that situation, we will provide one.

4. Advertising

Our Apps are free and supported by advertising. By using an App you accept that ads will be displayed, including video ads you may choose to watch in exchange for a reward. Ads are supplied by third-party networks, and we do not control and are not responsible for the content of any ad or the sites it links to. Report an inappropriate ad to support@omnigame.cc with a screenshot and we will pass it to the network.

5. Your content

If you send us feedback, bug reports or suggestions, you grant us a worldwide, royalty-free, perpetual licence to use them to improve our products, without obligation or compensation to you. Please do not send us anything you consider confidential.

6. Intellectual property

The App, its source code, artwork, characters, music, level designs and the OmniGame name and logo are owned by OmniGame or our licensors and are protected by copyright, trademark and other laws.

7. Updates and availability

We may release updates, change or remove features, and suspend or discontinue an App at any time. Some updates are required for the App to keep working. We do not promise uninterrupted or error-free operation.

8. Termination

You may stop using an App at any time by deleting it. We may suspend or terminate your licence if you materially breach these Terms — for example by cheating or committing ad fraud. Sections 5, 6, 9, 10 and 11 survive termination.

9. Disclaimers

Except where the law does not allow it, the Apps are provided "as is" and "as available" without warranties of any kind, whether express, implied or statutory, including merchantability, fitness for a particular purpose and non-infringement. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you, and nothing here affects consumer rights that cannot be waived.

10. Limitation of liability

To the fullest extent permitted by law, OmniGame will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising out of your use of the Apps. Our total liability for any claim relating to an App is limited to the greater of (a) the amount you paid us for that App in the twelve months before the claim, or (b) USD 50. Nothing in these Terms excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.

11. Governing law and disputes

These Terms are governed by the laws of Japan, without regard to conflict-of-law rules. Disputes will be submitted to the exclusive jurisdiction of the Tokyo District Court. If you are a consumer, this does not deprive you of the protection of the mandatory laws of your country of residence, and you may bring proceedings in your local courts where the law gives you that right.

12. Apple and Google

These Terms are between you and OmniGame only, not with Apple or Google. Apple and Google are not responsible for the App, its content, maintenance, support, or any claim relating to it, and are third-party beneficiaries of these Terms with the right to enforce them against you. You confirm you are not located in a country subject to a US Government embargo and are not on any US Government restricted-parties list.

13. Changes to these Terms

We may revise these Terms. The "Last updated" date shows the current version, and material changes will be announced in the App before they take effect. Continuing to use an App after that date means you accept the revised Terms.
